1. General Provisions
These Terms and Conditions (hereinafter referred to as the "Terms") govern the use of the AllAI platform, accessible at allai.ro, and all associated services. By accessing or using the platform, you confirm that you have read, understood and accepted these Terms in their entirety.
AllAI is a SaaS (Software as a Service) platform that offers chatbot and voicebot solutions based on artificial intelligence, designed to automate customer communication.
2. Definitions
- “Platform” — the allai.ro website and all applications, APIs and services offered by AllAI
- “User” — any individual or legal entity that creates an account and uses AllAI services
- “AI Agent” — a chatbot or voicebot created and configured by the User on the AllAI platform
- “End User” — a person who interacts with an AI Agent created by the User
- “Content” — any text, document, file, data or material uploaded to the platform
- “Subscription” — the pricing plan chosen by the User for access to AllAI services
3. Account Creation and Eligibility
To use the AllAI platform, you must:
- Be at least 18 years old or the legal age of majority in your jurisdiction
- Provide accurate, complete and up-to-date information when creating your account
- Maintain the confidentiality of your access credentials (email, password)
- Notify AllAI immediately in case of any unauthorized access to your account
You are responsible for all activities conducted through your account.
4. AllAI Services
AllAI offers the following main services:
- Creating and configuring AI chatbots for websites
- Creating and configuring AI voicebots for phone communication
- Training AI agents with your own documents and content
- Conversation analytics and report generation
- Integrations with third-party platforms (CRM, ticketing systems, etc.)
- Lead capture and management
We reserve the right to modify, update or temporarily discontinue certain platform features, with prior notification to users.
5. Subscriptions and Payments
5.1. Pricing Plans
AllAI offers multiple subscription plans with different levels of functionality and usage limits. Full details of each plan are available on the platform's pricing page.
5.2. Billing
Subscriptions are billed monthly or annually, depending on the chosen option. Payments are processed through PCI-DSS compliant payment providers. Invoices are issued in accordance with Romanian tax legislation.
5.3. Renewal and Cancellation
Subscriptions renew automatically at the end of each billing period. You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are granted for unused partial periods.
6. Intellectual Property
6.1. AllAI's Property
The AllAI platform, including source code, design, interface, AI algorithms, brand and all related materials are the exclusive property of AllAI and are protected by copyright and intellectual property laws.
6.2. User Content
You retain all rights to the content you upload to the platform. By uploading content, you grant us a limited, non-exclusive license to use that content solely for the purpose of providing AllAI services (for example, training your chatbot).
6.3. Feedback
Any suggestions or feedback provided regarding the platform may be used by AllAI to improve services, without obligation of compensation.
7. Acceptable Use
You agree not to use the AllAI platform for:
- Illegal activities or activities that violate the rights of third parties
- Distribution of discriminatory, defamatory, obscene or hate-inciting content
- Unauthorized collection of End Users' personal data
- Spam, phishing or any form of unsolicited communication through AI agents
- Attempting to gain unauthorized access to systems, data or accounts of other users
- Creating chatbots that impersonate real people without disclosing their AI nature
- Reselling or redistributing services without AllAI's written consent
Violation of these rules may result in account suspension or termination, without refund.
8. User Responsibility for AI Agents
As an AllAI platform User, you are responsible for:
- The accuracy and legality of content used to train AI agents
- Informing End Users that they are interacting with an AI agent
- Compliance with data protection legislation (GDPR) in your relationship with End Users
- Obtaining necessary consent for data collection through AI agents
- Monitoring AI agent behavior and correcting any incorrect responses
9. Availability and SLA
We commit to maintaining a 99.9% availability level (SLA) for the platform. However, you acknowledge that:
- There may be scheduled maintenance periods, with prior notification
- Force majeure circumstances may affect service availability
- AI-generated responses are not guaranteed to be 100% correct in all situations
10. Limitation of Liability
To the maximum extent permitted by law:
- AllAI shall not be liable for indirect, incidental or consequential damages
- AllAI's total liability is limited to the amount paid by the User in the last 12 months
- AllAI does not guarantee that AI agent responses are always correct or complete
- The User is solely responsible for decisions made based on information provided by AI agents
11. Account Termination
The account may be terminated in the following situations:
- By the User: by cancelling the subscription and requesting account deletion
- By AllAI: in case of Terms violation, with 15 days prior notice (except for serious violations)
- Automatically: after 12 consecutive months of inactivity
Upon account termination, you have the right to request the export of your data within 30 days. After this period, data will be permanently deleted.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of Romania. Any dispute arising from or in connection with these Terms shall be resolved amicably. In case an amicable resolution is not possible, the dispute shall be submitted for resolution to the competent courts of Romania.
13. Contact and Amendments
We reserve the right to modify these Terms at any time. Significant changes will be communicated at least 30 days before taking effect, via email or platform notification.
